Kyle Kleinhenz, 45, was arrested on May 19 and booked into the Fulton County Jail on one misdemeanor count of sexual battery, jail records confirmed.
The rideshare driver told police that she picked up Kleinhenz from Mr. C’s Bar and Grill on Howell Mill Road.
She said the 45-year-old inappropriately touched her during the ride, causing her to pull over for help.

The rideshare driver told police that the officer was sitting behind her, when according to the arrest affidavit, “He began pulling on her and rubbing her right arm.” She says she told him to stop, and he “repeatedly apologized” to her but continued to touch her.
Then, police say, the officer “pulled her back by grabbing her right breast while saying ”Damn, you so sexy,” according to the affidavit.
Fearful for her safety, the driver pulled into the RaceTrac along Bolton Road, where she flagged down a security guard who waited with her until police arrived.
Investigators attempted to speak with the accused officer, but according to the arrest warrant, he “was extremely intoxicated and unable to give a statement.”
On Thursday, Kleinhenz was relieved of duty, and an internal affairs investigation is underway.
APD Chief Darin Schierbaum has issued the following statement regarding Kleinhenz’s arrest:
“The Atlanta Police Department takes all allegations of officer misconduct with the utmost seriousness. We are committed to maintaining the trust of our community by holding our officers to the highest standards of integrity and professionalism. Any behavior that falls short of these expectations is thoroughly investigated, and appropriate action is taken.”
