Lawsuit claims Grady nurse’s aide sexually assaulted 73-year-old woman

The family of a 73-year-old woman is suing Grady Memorial Hospital, accusing a nursing support technician of sexually assaulting her while she was a patient.

According to the lawsuit, it occurred in October when the man, identified only as John Doe, reportedly entered Eva Lay’s hospital room and assaulted her. The family accuses the hospital of gross negligence and failure to provide proper security, Channel 2’s Audrey Washington reported.

Eva Lay died a few weeks ago due to unrelated health issues, but her family believes she suffered from mental health issues as a result of what they believe happened.

“It’s not really about the lawsuit to me, it’s about our mother,” said Daniel McGuire, Eva Lay’s son, at a news conference Thursday.

“She went to Grady Hospital, but instead of getting care she was violated in the worst possible way,” said Reginald Greene, an attorney representing the family.

The family said they have video evidence, including footage of Lay describing the incident and security footage showing the nurse technician entering and exiting her room.

“Security footage showed the nurse tech go in and out the room after the assault with a laundry basket where he discarded the sheets,” said attorney L. Chris Stewart.

Grady Memorial Hospital responded to the allegations with a statement.

“When we were made aware of this allegation, we immediately reported it to law enforcement and cooperated fully with their investigation,” they said. “APD found no physical evidence to substantiate this claim. We defer to law enforcement regarding any additional information they wish to release.”

The Atlanta Police Department confirmed that the investigation is ongoing.

“Hopefully we’ll come forward with more victims if this is happening, because he’s getting away with it with ease, but that stops now,” Stewart said.
