Channel 2’s Michael Seiden learned Friday they were also suspects in a drive-by shooting.

Multiple court documents give new insight into what happened before during and after the chase.

“We found out that they were in the process of stealing that vehicle, so our officers try to block the vehicle in,” said Lt. Carlos Nino of Brookhaven PD.

It happened a little more than two months ago on I-285 near Peachtree Industrial Boulevard. Multiple police agencies attempted to stop a stolen SUV carrying the three teens, Brookhaven police said.

“Heavy smoke coming from the vehicle. It looks like they’re putting a fire extinguisher out,” an officer says in dashcam video of the chase.

The suspects were also charged in connection with a drive-by shooting in DeKalb County.

Investigators arrested and charged 17-year-old Octavio Luviano and two of his friends, both aged 15. The crash left Luviano with visible injuries, and after a trip to the hospital, police booked him into jail on multiple felony charges, including seven counts of aggravated assault with a deadly weapon and entering an automobile with intent to commit theft or a felony.

Before the chase and crash, Brookhaven police responded to reports of the suspects attempting to steal a second vehicle. The Brookhaven police drone first responder program was instrumental in locating the black Nissan involved in the attempted theft.

Luviano is currently out on bond but scheduled to be back in court in the coming months.
